Known issue with my phone, can I upgrade early?

I have a Sony Xperia Aqua M4 and until September it was working great. Then suddenly, every time I put it into standby the phone would say no SIM detected. I restart, issue goes away then comes back again.

Finally fed up today, I did a search on Google and found several others have had issues with this. Repairs didn't work, new replacement phones had the fault, so if I call and speak to Virgin about this, would I be within my rights to ask to replace with a different model a year early? Or am I stuck with this annoying phone until next November?

If it's not fit for purpose then it should be replaced. Standard consumer protection law.
